City approves reconstruction project for Seventh Avenue

West Fargo City Commissioners voted unanimously Monday night to agree with the project concept and approved a plan for the reconstruction of 7th Avenue East from 17th Street East to 45th Street.

After reviewing the executive summary as presented by Assistant Public Works Director Chris Brungardt, the commission chose from four alternatives the one involving reconstructing the roadway as a 41 foot, two-lane section with protected 10-feet street parking lanes, a continuation of a previous leg of work done from 9th Street East to 17th Avenue East.

Pavement failure is necessitating the work. The entire length of the road is in extremely poor condition with areas of rutting, cracking, and failed full depth patching.

The roadway serves West Fargo High School, three large residential subdivisions asw well as a commercial development

Total cost of the project is $1,095,441. The Federal share is $847,775. The local share is $199,766 which will be split between Fargo and West Fargo, because the work is on a roadway that borders both cities. Each city will fund their own underground work which is estimated at $167,975 for Fargo and $222,100 for West Fargo There should be no special assessments for this project. It will be funded through the city’s Street Resealing Fund.

The action will now be taken to Fargo city officials for their concurrence. A Nov. 15, 2013 bid opening date is being looked at for the work with the project expected to begin next spring as weather allows.

The commission also okayed a planned unit development amendment for a hotel and a restaurant at 925 19th Ave. E., per a request by StaySharpe that allows for modifications to the hotel site.

According to project developer and West Fargo resident Kyle Newman those modifications include changing the brand from Aloft Hotel to Element Hotel which he said should fit the needs of a lot of guests due to all the development in the area. “We view that this more extended stay will fit the needs alot better supporting a three-plus night stay,” Newman stated.

The 130-unit hotel will feature a swimming pool and outside courtyard. An October 2014 completion date is being earmarked.

There will also be a restaurant on the site but who that will be has not yet been decided.

In other action, the commission:

  • approved amendments to Ordinance No. 970 relating to Firearms or Dangerous weapons so it conforms with the state statute which will go into effect Aug. 1 after action taken in the last legislative session. The general public shouldn’t notice any changes. The adjustments involve municipal court judges who now don’t have to be licensed to carry a gun, and there is an exemption for carrying a concealed weapon in church, if the individual is properly licensed and church leadership permits it. Any violations of the ordinance will also be Class B Misdemeanors:
  • okayed a planned unit development amendment for Lots 1-3, Block 1, and Lots 11 and 12, Block 2, of Hayden Heights Addition. NCDI made the request to allow for construction of larger single family homes and accessory buildings on the property located on the north side of 40th Ave. W about two miles south of I-94 and one mile west of Sheyenne St.
  • approved a conditional use permit allowing for additional signage height of 10’3” for Meadow Ridge Bible Chapel located in a residentially zoned district at at 2198 2nd Ave. E., West Fargo. The sign will also include an electric reader board than can be operational only from 6 a.m. to 10 p. m.;
  • okayed a conditional use permit for an oversized accessory building at 3813 Sheyenne St. per a request by John Rust. The applicant is proposing a detached garage totally 1152 sq. ft., larger than the 1,000 sq. feet allowed for, causing the need for a CUP;
  • approved a conditional use permit for signage at 800 40th Ave. E., per a request by the Mustang Boosters, to allow for animated message sign with off-premise advertising for a school. A middle school is currently under construction on the north side of the lot and Sheyenne 9th Grade Center located on the south side of the lot is being converted into a high school. A CUP allows for off-premise signs in a Public District. The sign is consistent with the one previously approved for West Fargo High School;
  • approved second l reading for rezoning and gave final plat approval to Brooks Harbor 2nd Addition from agricultural to single family dwelling per a request by Brooks Harbor Development to allow for single family development. The approximate 43 acre site, located south of I-94 and west of Sheyenne Street, was annexed into the city in 2005;
  • approved second reading of rezoning and gave final plat approval to Shadow Creek Development to rezone Shadow Creek 5th Addition from agricultural to single family dwelling so single family development can occur. The 25.86 acre parcel, located south of 36th Avenue East and along 4th Street East was annexed into the city in 2005;
  • following a public hearing at which no one voiced protest offered second reading to Ordinance No. 959 involving the annexation of the Beaton property.

The next regularly scheduled meeting of the West Fargo City Commission will take place Monday, July 29 at 5:30 p.m. in the Commission Chambers at West Fargo City Hall, 800 4th Ave. E. A meeting to continue discussion on the 2014 budget will take place immediately following. All meetings are open to the public.
