3 charged with sexual assault of 12-year-old plead guilty to lesser counts
FARGO — Three men who faced sexual assault charges after they were accused of having sexual contact with a 12-year-old girl in a Fargo hotel room pleaded guilty to lesser charges and were sentenced to jail time they have already served.
According to Cass County District Court records:
Augustine Addy, of West Fargo, and Hutchingson Davies and Daniel Gowah, both of Fargo, were charged in April with one count each of felony gross sexual imposition and one count each of misdemeanor sexual assault. Addy was 23 at the time, Davies was 21, and Gowah was 20.
The charges followed a police investigation that began when police were called to a Fargo hospital on Feb. 28 for a sexual assault report.
The mother of a 12-year-old girl said she had learned of an assault from a family friend, and the girl told a child advocate that she and a friend were raped by three men in a hotel room Feb. 25.
The girl also said they drank alcohol and smoked marijuana at the hotel, according to court documents.
On Wednesday, Sept. 5, Gowah pleaded guilty to a misdemeanor count of contributing to the deprivation or delinquency of a minor, and was sentenced to jail time he has already served, about 139 days.
In a separate case, Gowah admitted to passing a counterfeit $100 bill at a convenience store and was sentenced to time served.
Addy and Davies earlier pleaded guilty to one count each of misdemeanor contributing to the deprivation or delinquency of a minor, and were also sentenced to time served. That was 102 days for Addy, and 138 days for Davies.
The sexual assault charges the men faced have all been dismissed.
At Wednesday's plea hearing for Gowah, prosecutor Reid Brady told the court that the mother of the 12-year-old was aware of how the case was being resolved. And he said the victim's current emotional state was a factor in how the case was being resolved.
