With the recent heavy snowfall, people are scrambling to find places to put snow.
The West Fargo Street Department works hard to try to keep the streets clear. After the plow trucks go by, your driveway is full of snow again and it seems like all of your hard work was in vane. The easiest solution is to push the snow back into the street. Now that snow pile becomes someone else's problem.
West Fargo Police get several calls a day about neighbors piling snow on the boulevard or blowing or pushing snow from their driveway onto the street. Officers will respond to the complaint and see if a violation has occurred. If the officer confirms a violation, the officer will give a verbal warning to the violator, explain the city ordinances, and have them clean up the snow that was deposited improperly. If the violation continues, officers will complete a report that will be sent to the city prosecutor for review, resulting in the violator appearing in municipal court.
We need to work together in dealing with all of the snow; we can pile it up as high as we can, or you can pay a contractor to haul out your snow piles. Snow and snow piles are just a fact of life and we need to be respectful of our neighbors and others.
West Fargo has city ordinances for snow issues:
West Fargo ordinance 12-1102 Unlawful Dumping and Littering by Contractors, states that contractors cannot deposit snow and ice on any street, alley, or public place, including boulevards not part of your residence.
12-1101. Unlawful Dumping and Littering By Contractors. No contractor shall allow any vehicle to operate out of any construction site, regardless of whether the same shall be operated by the contractor, his agents, employees, or subcontractors, in such a manner as to dump, scatter, or deposit any rubbish, stones, wire, earth, ashes, cinders, sawdust, hay, glass, manure, filth, paper, snow, ice, dirt, grass, leaves, twigs, shrubs, construction waste, garbage, or other offensive or nauseous material on any street, alley, or public place. The public works director shall be and hereby is empowered to order any contractor to take such precautions as he deems necessary to prevent any such foreign materials from being deposited on the street, alley, or public place and to remove all foreign material on the street, alley, or public place. If, and in the event any contractor shall fail to comply with the order of the public works director, said director, or the chief of police, may order all construction stopped.
West Fargo ordinance 13-0706 Dumping of Snow on City Street Prohibited, states that it is unlawful for any person to deposit snow from any private property including sidewalks on to the street.
13-0706. Dumping of Snow on City Street Prohibited. It shall be unlawful for any person, association, partnership, corporation, or other entity to deposit, place or dump, or permit or authorize the depositing, placing or dumping of any snow removed from any private property or city right-of-way, including public sidewalks and private driveways located upon the street right-of-way upon any city street. It shall further be a violation of this section to deposit, place, or dump, or permit or authorize the depositing, placing or dumping of any snow upon public right-of-ways other than from adjacent sidewalks and driveways.
